HeartCosmos Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and HeartCosmos Inc. (“HeartCosmos,” “we,” “us,” or “our”). They govern your access to heartcosmos.com and our related services (the “Services”).
Please read these Terms before using the Services. By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Who We Are

2. Eligibility
You must be at least 18 years old and legally able to enter into this agreement. By using the Services, you confirm that you meet these requirements.
The Services are offered only where their use is lawful. You are responsible for following the laws that apply to you.
3. The Services
HeartCosmos provides AI-assisted guided reflection, interactive questions, Life K-Line, Guardian experiences, and a personal Cosmos where you can save insights from your explorations. Some experiences use symbolic perspectives inspired by wisdom and astrological traditions from cultures around the world.
Features may change as the Services develop. A feature description is not a promise that the feature will always be available in the same form.
4. AI and Symbolic Experiences
HeartCosmos uses artificial intelligence to generate questions, summaries, suggestions, visual concepts, and other outputs based on information you provide. AI outputs may be inaccurate, incomplete, or similar to content generated for other users. They are not statements of fact, predictions, or professional advice.
Life K-Line, Guardian, and other symbolic experiences are designed for personal reflection and entertainment. They do not determine your identity, reveal a fixed destiny, predict future events, or guarantee an outcome.
You remain responsible for deciding whether and how to use an output. Do not rely on HeartCosmos as the sole basis for medical, psychological, legal, financial, employment, relationship, safety, or other significant decisions. When appropriate, seek advice from a qualified professional.
HeartCosmos is not an emergency or crisis service. If you or someone else may be in immediate danger, contact local emergency services.
5. Accounts and Security
Some features may be used without an account for a limited period. To save and restore your personal Cosmos, you may need to sign in with a supported login method.
You agree to provide accurate information, keep access to your email and device secure, and promptly tell us if you suspect unauthorised use. You are responsible for activity performed through your account unless applicable law provides otherwise.
You may not sell, transfer, share, or allow another person to use your account to avoid access or payment limits.
6. Acceptable Use
You may not use the Services to:
- break the law or violate another person’s rights;
- submit content that is unlawful, threatening, abusive, defamatory, exploitative, or sexually explicit involving minors;
- impersonate another person or misrepresent your identity or authority;
- collect, expose, or misuse another person’s personal information;
- harass, threaten, or harm users, staff, or any other person;
- interfere with, overload, probe, or bypass the security or access controls of the Services;
- introduce malware or use automated methods that place an unreasonable burden on the Services;
- reverse engineer or extract models, prompts, source code, or protected systems except where applicable law expressly permits it;
- use the Services or outputs to build or train a competing model or service without our written permission; or
- use the Services to make high-impact decisions about another person in areas such as employment, housing, credit, insurance, education, healthcare, or legal services.
We may investigate suspected misuse and take proportionate action, including limiting access, removing content, or suspending an account.
7. Your Inputs, Outputs, and Saved Content
“Input” means content you submit to the Services. “Output” means content generated in response to your Input. “Saved Content” includes Stars, Guardian results, Cosmos content, and other items stored for you.
You retain any rights you have in your Input. You give us a limited, worldwide, non-exclusive licence to host, process, reproduce, and display your Input only as needed to provide, secure, and maintain the Services, comply with law, and carry out any additional use to which you have separately agreed. This licence ends when the information is deleted from our active systems, except where limited retention is required by law, security needs, or ordinary backup cycles.
You confirm that you have the rights needed to submit your Input and that doing so does not violate these Terms or another person’s rights. Do not submit confidential information belonging to another person or organisation without permission.
Subject to applicable law and third-party rights, you may use Outputs generated for you for personal purposes. Because AI systems can generate similar outputs for different users, Outputs may not be unique and we do not guarantee that they can be protected by intellectual property rights.
We do not use private exploration content to train general-purpose AI models unless you separately and actively choose to participate in a clearly described optional programme.
8. Fees, Subscriptions, Cancellation, and Refunds
Some Services may be free and others may require payment. Before you pay, we will show the price, currency, billing basis, and material restrictions that apply.
If we offer a recurring subscription, the checkout page will state the billing period and whether it renews automatically. By purchasing an automatically renewing subscription, you authorise the applicable payment method to be charged at the start of each billing period until you cancel. You can cancel through the method described at purchase or in your account. Cancellation stops future renewals and does not normally create a refund for a period that has already begun, except where required by law.
We may change prices for future purchases or renewal periods after giving reasonable notice. Taxes may be added where required.
Except where required by applicable law, fees for digital services already fully delivered are non-refundable. If a paid service is not delivered because of a verified technical failure on our side, contact [email protected] within 14 days. We will investigate and, where appropriate, restore access, re-deliver the service, or issue a refund.
Nothing in these Terms limits any mandatory cancellation, withdrawal, refund, quality, or consumer rights that apply to you. If the law requires your express agreement before immediate delivery of digital content affects a withdrawal right, we will request that agreement during checkout.
9. HeartCosmos Intellectual Property
The Services, including our software, interface, branding, original text, graphics, designs, Guardian artwork, report formats, and other materials created by or for HeartCosmos, are owned by HeartCosmos or its licensors and are protected by applicable intellectual-property laws.
We give you a limited, personal, non-exclusive, non-transferable, and revocable right to use the Services in accordance with these Terms. These Terms do not transfer ownership of the Services or our intellectual property to you.
Third-party materials remain the property of their respective owners and may be subject to separate terms.
10. Privacy
Our Privacy Policy explains how we collect, use, share, retain, and protect personal information. By using the Services, you acknowledge that you have read it.
Any optional permission to use content for research, model improvement, or marketing must be presented separately and is not a condition of accepting these Terms unless the use is strictly necessary to provide the Services.
11. Service Availability and Changes
We work to keep the Services available, but we do not promise uninterrupted or error-free operation. Maintenance, security events, technical failures, third-party outages, legal requirements, or events outside our reasonable control may affect availability.
We may add, change, limit, or discontinue features. If a material change significantly reduces a paid service during an active paid period, we will provide any notice or remedy required by applicable law.
12. Suspension, Termination, and Account Deletion
You may stop using the Services at any time. Where account controls are available, you may request deletion of your HeartCosmos account and associated data. Deletion is irreversible once completed.
We may suspend or terminate access if we reasonably believe you have materially breached these Terms, created a security or legal risk, failed to pay an amount due, or used the Services in a way that could harm others or the Services. Where reasonable and lawful, we will provide notice and an opportunity to address the issue. We may act without advance notice in urgent security, abuse, or legal situations.
After termination, your right to use the Services ends. Provisions that by their nature should continue—including intellectual property, payment obligations, disclaimers, liability limits, and dispute terms—will remain in effect.
13. Disclaimers
To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available.” We do not guarantee that the Services will always be available, secure, accurate, complete, or suitable for your particular purpose.
HeartCosmos is intended for self-discovery, reflection, and entertainment. It does not predict future events or guarantee outcomes and does not provide medical, psychological, legal, financial, religious, or other professional advice.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
14. Limitation of Liability
To the fullest extent permitted by applicable law, HeartCosmos and its directors, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or related to the Services.
To the fullest extent permitted by applicable law, our total liability arising from or related to the Services or these Terms will not exceed the greater of: (a) the amount you paid to HeartCosmos for the Services during the 12 months before the event giving rise to the claim; or (b) USD 100.
These limitations do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
15. Governing Law and Disputes
These Terms are governed by the laws of [GOVERNING JURISDICTION], without regard to conflict-of-law principles. Courts located in [GOVERNING JURISDICTION] will have jurisdiction over disputes, unless mandatory consumer law gives you the right to bring a claim in another court or under another law.
Before filing a formal claim, you and HeartCosmos agree to make a reasonable effort to resolve the issue informally. Send a description of the issue and the outcome you seek to [email protected]. This does not prevent either party from seeking urgent relief or exercising a right that cannot legally be restricted.
16. Changes to These Terms
We may update these Terms as the Services or legal requirements change. We will post the revised Terms with a new “Last updated” date. For material changes, we will provide reasonable advance notice. If the law requires your renewed agreement, we will ask for it before the change applies to you.
17. General Terms
These Terms and the Privacy Policy form the agreement between you and HeartCosmos regarding the Services, together with any additional terms clearly presented for a specific paid feature.
If a provision is found unenforceable, the remaining provisions stay in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. We may transfer these Terms as part of a merger, reorganisation, sale of assets, or similar transaction, subject to applicable law.
Headings are provided for convenience and do not change the meaning of these Terms.
18. YouTube Data API
This website integrates YouTube Data API services. All use of YouTube API functions is subject to the YouTube API Services Terms of Service. Users may use our platform to search public YouTube videos and embed playback. Authorized users may upload videos and manage their own YouTube channel content via our website. We comply with all YouTube developer policies.
